A man allegedly held his transgender lover hostage in their eastern suburbs apartment with a fishing knife and refused to let them eat, drink, sleep or use the toilet.
It is alleged Dale Fraser-Fazldad then bit police when the complainant was able to secretly dial triple-0, a court has heard.
The 26-year-old appeared in the dock at Waverley Local Court last week charged with the alleged reign of terror on his partner of two months Joseph Stanislav, 56, who identifies as both male and female.
Magistrate Ross Hudson heard Fraser-Fazldad returned to the couple’s Bellevue Hill apartment at 6pm on Friday November 6 with the fishing knife.
The prosecutor told the court the accused “appeared to be under the influence of drugs and alcohol” and the pair had an argument that lasted until the early hours of the following morning.
The court was told Stanislav was allegedly slapped in the face and then things took a darker turn.
The prosecutors said: “He (Fraser-Fazldad) removed the knife from its sheaf and said “listen c*** you f***ing dog, you think I’m scared to slice you?”
“Stanislav could feel the blade slice across (their) neck however it did not cut them.”
The court was told Fraser-Fazldad accidentally “punctured his own abdomen” with the knife and “smashed a skol shaped mug” against his own forehead.
“He held (Stanislav) at knifepoint and refused to let him eat, drink, sleep or use the toilet,” the prosecutor said.
Police allege eventually Fraser-Fazldad relented and allowed Stanislav to use the bathroom, however he ended up kicking in the door.
The court heard Stanislav was finally able to discreetly call police at 10.50am on Saturday November 7.
“The accused engaged in a physical altercation with police and bit an officer on the forearm,” the prosecutor said.
Legal Aid’s Ms Lopez who represented Fraser-Fazldad said as there were “no third parties” it was a case of one person’s word against the other.
She said this is not the first time Stanislav has been the alleged victim of an attack.
“Your Honour has been sitting on the bench at Waverley Local Court for long enough to have seen that he is not the first … he (Fraser-Fazldad) is the latest in a number of people who seem to be involved with Mr Stanislav and seem to be in custody,” Ms Lopez said
“Stanislav can only suggest what seem to be movie style facts of what has occurred.
“Police don’t note any injuries to Mr Stanislav.
“The only one who is injured is Mr Fraser-Fazldad”
Ms Lopez said Fraser-Fazldad wished to return home to Kempsey if granted bail to stay with his aunt and sister.
Magistrate Hudson formally refused to grant Fraser-Fazldad bail as he believed he was an unacceptable risk to the community.
He will next appear in court on January 20 on charges of detaining a person with intent, common assault, being armed with intent, assault police and two counts of damage property.
