A Bondi model and influencer has been told she was “out of control” and entitled after she was caught driving on a disqualified licence.

Brittany Jayne Hamilton, an influencer with more than 25,000 Instagram followers appeared in Waverley Local Court on Wednesday after previously pleading guilty to drive motor vehicle during a disqualification period.

Agreed facts reveal the 21-year-old was driving a Suzuki Swift on Oxford St, Woollahra where she stopped at an alcohol and drug testing site about 8.50pm on January 2.

Hamilton, who was with a female passenger, told police “I don’t have my licence. I’m suspended”.

Police checks found Hamilton was a P-plater and she was disqualified from driving from June 7, 2022 to May 11, 2023.

Court documents state the 21-year-old was also stopped in August and charged for the same driving while disqualified offence.

The court heard at the time of the offence, Hamilton was in breach of a community corrections order (CCO) for affray from an incident at Terrigal on January 24, 2021.

Magistrate Jacqueline Milledge said Hamilton was “out of control”, listing previous charges, including low-range drink driving in 2019, affray and other driving offences.

Hamilton’s lawyer Christopher Wozniak said she worked in retail “and does a bit of modelling on the side” before the magistrate revealed she didn’t know whether Hamilton “will be going home today”.

Magistrate Milledge called for a sheriff to assist the court and detailed Hamilton’s “absolutely appalling behaviour” when reading over the facts for the call up matter of affray.

“Geez I had no idea how aggressive your client was,” she said. “Looking at her driving record … it’s pretty indicative of her [lifestyle] … [she thinks] it’s all about me”.

Mr Wozniak described his client’s driving while disqualified offence as “serious”.

“This is the third of this [offence] … if it continues, she drives herself into jail,” he said.

Magistrate Milledge replied “if she’s not already there today”.

In sentencing, the magistrate asked Hamilton “who do you think you are?”

“You think you’re fabulous,” Magistrate Milledge said.

“You’re a young lady who thinks she has a sense of entitlement … you think you are so untouchable … you don’t realise you are letting your life [unravel].

“You have been the closest … going to jail you ever want to be in your life. You won’t be driving for a long, long time.”

Hamilton’s bond for affray was revoked and she was placed on a new two-year CCO. She was also handed a three-year CCO for driving disqualified, disqualified for 12 months and ordered to undertake 200 hours of community service work.

“It gives you an opportunity to look after someone besides yourself,” Magistrate Milledge said.
