A Wagga man who allegedly went on a crime spree and used a six-inch serrated knife in an armed robbery will fight the charges at a trial next week.
Michael William Carr has pleaded not guilty to 12 charges including robbery armed with offensive weapon, aggravated break and enter to deprive someone of their liberty and break and enter offences.
A legal team for Carr made an application for the trial to be before a judge rather than a jury, however it was opposed by the office of the Director of Public Prosecutions.
In court on Friday, it was revealed the prosecution case would allege Carr committed multiple offences over two days in May, 2020 including breaking into an aged care home and carrying out an armed robbery at the Forest Hill Foodworks.
The defence application raised concerns over potential prejudice issues that could arise during a jury trial.
Magistrate Tanya Bright handed down her judgment and granted the defence’s application.
She was satisfied that “the order is in the interest of justice” due to concerns around matters of prejudice with a jury.
The trial is due to start next week, with opening statements expected to start on Wednesday.
