Jason Peel sentenced for drink driving in East Wagga Wagga

The ridiculous reason a Wagga truckie was caught drink driving well over the legal limit has been revealed in court as a magistrate heard the man was set to lose his job due to his actions.

A Wagga truckie was caught drink driving at more than twice the legal limit because he had ducked out for an ice cream in the middle of winter, a court has heard.

Jason Peel, 42, was charged with mid range drink driving on June 8 in East Wagga after police detected him making a minor traffic violation.

The crime was charged as a second offence – which carries higher penalties in court – because Peel had been caught driving with an illicit substance in his system in August 2017.

Agreed police facts tendered to Wagga Wagga Local Court reveal the Tolland man was driving along Hammond Ave in East Wagga when he was pulled over.

A subsequent breath analysis returned a result of 0.106.

“He admitted to having consumed one can of cider, which was two and a half standard drinks, at his home address,” police state.

“He said ‘I went to get an ice cream’.”

At court on July 18, Magistrate Christopher Halburd noted the truck driver would lose his job once his licence was suspended.

“He’s a truck driver, he is going to have a limited capacity to pay a fine,” Mr Halburd observed.

“He won’t be working.”

Peel pleaded guilty to the offence and was convicted, fined $600, and disqualified for six months from the day he was suspended by police.

He will then have to have an interlock licence for two years.
