Anti-vax protester Paul Raymond Hercules in court

A man who was dramatically arrested out the front of a Wagga courthouse after he failed to wear a mask has been hit with two fresh charges.

A 48-year old man who was dramatically arrested outside Wagga Local Court in October after allegedly trying to enter the premises without a face mask is facing fresh charges.

Paul Raymond Hercules, 48, from Tolland, was back in court after he refused to wear a face mask when entering the courthouse in October for matters regarding breaching Covid health guidelines for gathering at a protest earlier this month.

Mr Hercules is facing nine charges including two fresh more charges of assaulting a person acting in aid of an officer and resisting a police officer in their execution of duty.

Mr Hercules entered a plea of not guilty to seven charges in October including resisting an officer, unlawfully participating in an outdoor gathering, failing to comply with carrying a face mask, leaving home without a reasonable excuse, failing to comply with noticed direction and for using offensive language in public.

Mr Hercules appeared before Magistrate Christopher Halburd on Tuesday when asked if he is representing himself, Mr Hercules responded, “I am representing legal fiction.”

“I was brought fraudulent paperwork and I did not read it as I didn’t understand it as it was in a foreign language,” Mr Hercules told the court.

Mr Halburd told Mr Hercules the paper work was in English, to which Mr Hercules said the court documents were written in a “dead language.”

Mr Halburd told the court pleas of not guilty would be entered on his behalf.

“Mr Hercules doesn’t accept that court has any jurisdiction, we will have to proceed to a hearing as he refuses to enter a plea, the court will need to enter a plea,” Mr Halburd told the court.

Magistrate Halburd set a hearing date for July 6, 2022, and Mr Hercules said he would “like it to work it out much quicker.”

“We would all like it to be done much quicker, but there has been a global pandemic and there is a delay,” Magistrate Halburd responded.

“An alleged global pandemic,” Mr Hercules said.

“Hundreds of thousands of people have died, sir,” Magistrate Halburd said.

“It is alleged that thousands have died,” Mr Hercules responded.

Mr Hercules will appear before Wagga Local Court on December 21 to be served a brief of evidence.

The matter will then return to court on July 6 next year for a hearing.
