A taxi driver accused of a hit and run that left a 51-year-old man dead on a roadside is defending his charge.

In November last year, David Edward Blake, 58, was charged with one count of failing to stop and assist after vehicle impact causing death following an alleged hit and run.

Court documents state that Blake is alleged to have been driving a Toyota Camry at the time of the impact with Mr Hackett about 10.14pm on Red Hill Road in Lloyd on October 26.

Blake, of Wagga, was excused from appearing in Wagga Local Court today before magistrate Christopher Halburd.

However, his solicitor, Zac Tankard, formally entered on his behalf a plea of not guilty.

Police prosecutor Sergeant Kate Williams previously indicated that the matter would be referred to the Office of the Director of Public Prosecutions.

The prosecution’s brief of evidence will be served to Blake and Mr Tankard by May 13.

They will need to reply by May 27, which is when the matter is scheduled before the court again.
