An elderly man facing a police pursuit charge has missed a court appearance after soiling himself in the police station cells moments before hand.
Larry Joseph Bolan, 79, of Tilba Tilba, was refused bail on January 27 on charges of dangerous driving, police pursuit – not stop, two counts of driving while never licenced, and resisting arrest.
He has not yet entered a plea.
Bolan was initially scheduled to appear in Batemans Bay Local Court on Monday, however, Magistrate Doug Dick said the matter would have to be adjourned following the incident in the cells.
“He’s not fit to come into court and, if he did come into court, we would have to adjourn it to have it cleaned,” Magistrate Dick said.
Bolan’s lawyer Geoff Knox said the matter should also be adjourned to allow for a full psychiatric assessment.
“It’s clear he has some issues, needs care and is going to need a full assessment,” Mr Knox said.
Police will allege officers attempted to pull Bolan over on the morning of January 27 on the Kings Highway outside Nelligan.
Bolan allegedly failed to stop, and police started a pursuit.
Bolan’s sedan was finally stopped near the intersection of the Princes Highway and Beach Road next to McDonald’s, where he allegedly refused to get out of the vehicle.
He was forcefully removed from the car and arrested before being taken to Batemans Bay Police Station and charged.
Bolan will undergo a full psychiatric assessment before his next appearance at Batemans Bay Local Court next month.
