A female security guard who “violently” dragged a woman across the road by the ankles after she was kicked out of a south coast pub has been convicted.

Chloe Kres, 26, was sentenced for assault occasioning in actual bodily harm at Nowra Local Court on Tuesday following a previous plea of guilty.

The court heard the victim, “a young female”, had entered the Huskisson Hotel with friends and consumed “multiple” mixed vodka drinks, which resulted in the group becoming intoxicated.

Agreed facts tendered to the court reveal the victim stood behind the DJ equipment prompting the venue’s security guard Kres, along with other security, to remove the drunk patron.

In protest, the woman lay down on the path next to the front door of the hotel and refused to leave.

Kres asked the drunk woman to leave multiple times before she grabbed her ankles and dragged her off the path, over the gutter and across the road.

Agreed facts state the assault left the victim with a bump to her head, grazes on her back, legs and arms, and cuts to her knees.

“The victim tried to grab onto the road as she was dragged to stop it,” agreed facts state.

The victim’s friend rushed to her side, before calling police who questioned Kres on arrival and viewed CCTV footage of the altercation.

“I’ve read the facts and watched the video and this is a serious example of assault,” magistrate Lisa Viney said.

Kres’ lawyer Phillip Carey called on the court to avoid imposing a conviction in light her clients’ lack of criminal record, and said such a penalty would stop her from being able to continue as a security guard.

“She’s not a thug,” he said. “This isolated event was extremely out of character for her.”

Ms Viney said it was the duty of security guards to always treat patrons with respect.

“This is far too excessive for someone who was clearly intoxicated,” she said.

Kres was convicted and sentenced to a 12 month community correction order.
