Bronson Martin: Nowra man charged with drink driving

A south coast man has been busted drink driving with a suspended licence after a vodka-fuelled night, all while serving a sentence for resisting police, assault and damaging property.

A south coast man previously sentenced for hindering police and resisting arrest has now been busted drink driving with a suspended licence after a night out, a court has heard.

The incident saw Bronson Martin, 22, appear before Nowra Local Court on Tuesday, facing charges of mid range drink driving and driving with a suspended licence.

The South Nowra man previously pleaded guilty to the charges.

The court heard on Tuesday how the new offences arose while Martin was serving a community release order for previous charges of hinder or resist police officer, destroy or damage property and common assault.

Martin pleaded guilty to these matters mid last year, before he was sentenced to the community release order.

However, documents tendered to the court reveal while serving the 12 month community release order, Martin came under the eye of police again, this time while driving a Mitsubishi CE strangely along Nineveh Cl, Nowra, in the early hours of July 7 this year.

The court heard police watched Martin driving the car after he enjoyed a “night out” drinking multiple vodka Red Bulls.

Agreed facts state the officers pulled Martin over and subjected him to a breath test, which returned a positive result of .117 – two and a half times the legal limit.

The police officers ran a check of his licence, which revealed it was suspended.

Martin was arrested and taken to Nowra Police Station, before being charged and issued a court attendance notice.

In court, Martin’s lawyer Rachel Winter said her client made “no excuses”.

“It was a night out and it was something he knew he shouldn’t have done,” she said.

Ms Winter noted her client completed the Traffic Offenders Program since the incident.

“It’s opened his eyes to the risk he put to the community,” she said.

However, Magistrate Lisa Viney said it was a serious matter, acknowledging it occurred after resisting police officers.

“You were serving a community release order for a number of other offences,” she said.

“Not only were you driving suspended, but you put the community at risk.”

Martin was convicted, fined $1350, had his licence suspended for an additional three months and will need an interlock device installed for one year once his licence is reinstated.
