A man has been caught out breaching his apprehended violence order (AVO) after being arrested for spitting at a police officer.

Beau Haile, 29, pleaded guilty to contravening an AVO and assaulting a police officer at his Stroud home on Wednesday.

Police had been called to Mr Haile’s Berkeley St home on a number of occasions after neighbours heard loud arguments coming from the premises.

At around 10.30am, a Dungog police officer attended the residence and found ladies clothing and cosmetics on the side of the verandah.

Police facts said the officer spoke with Mr Haile who stated he had not seen a woman - who was under a protection order since March - and that he had an argument with his mother.

He denied the officers request to look around the house and as the senior constable walked away to leave, he spat on the back of his neck.

Concerned for his own welfare in the current COVID-19 climate, the officer deployed capsicum spray before arresting Mr Haile.

During a search of his home, a 32-year-old woman was found in the dining room and told police she had nowhere else to stay.

In a later interview with police, Mr Haile apologised for his actions.

“I am sorry about what I did, I didn’t want to say I was with her because she had nowhere to go and I thought I’d get in trouble if I told you,” he said in police facts.

He then shook the hand of police officer involved and apologised again.

In Newcastle Local Court on Thursday, Mr Haile was granted bail and ordered to comply with the current AVO.

He’ll learn his fate in June, when he’s set to be sentenced at Raymond Terrace Local Court.
