Jayden Young, the brother of Canberra Raiders rookie star Hudson Young, has had his name cleared after 11 charges of assault and property damage were dismissed against him in Newcastle Local Court on Friday.
The result comes as his brother prepares to cheer on his teammates from the sidelines at Sunday’s NRL grand final, after he was rubbed out for eight games for a second eye gouge offence.
Jayden Young who plays for the Kurri Kurri Bulldogs in the local Newcastle Rugby League competition, had all charges withdrawn by the prosecution after Magistrate David Price rejected an application for an adjournment.
In a second hearing scheduled both the complainant and the victim failed to show in court.
They were set to give evidence in the prosecution’s case against the accused.
“These are serious allegations, which are domestic violence related, however when a person is charged of any offence it has a serious impact on their life,” Magistrate Price said.
“Anyone in legal proceedings knows how burdensome they can be, but it cannot be the case that a person can make allegations against someone, and it goes on indefinitely. That is a denial of natural justice and inherently unfair.
“Justice is for defendants as well and I cannot see any reason for a person to be continually affected by delays in this matter, so this application is denied.”
Young was cleared of all 11 charges including six charges of assault, four charges of property damage and one charge of assault occasioning actual bodily harm, but an AVO will remain for 12 months.
Court documents revealed Young had been accused of numerous assaults against his then girlfriend from December late last year. Police reports also documented several arguments between the pair.
Outside court, Young’s lawyers Drew Hamilton and Rob Hussey said their client had respected the decision handed down by the court and that he was looking forward to moving on.
Young was recently one of several Kurri Bulldogs players charged by the Newcastle Rugby League match review committee after a late send off in the club’s final match of the 2019 season against the Central Newcastle Butcher Boys.
He was suspended for three matches, which will carry over to the 2020 season.
