A teenage woman tied a man up in the back of her car promising some type of “sexual kinky activity” as a form of psychological payback,” a court has heard.

Talia Rose Dodd, 20, was homeless and started living with a man 17 years her senior at his Anna Bay home in Port Stephens. She paid him $50 rent weekly with the pair also beginning an intimate relationship.

The court heard Dodd - who was 18 at the time - left the arrangement, but the returned to the home on February 6, 2023, in the early hours of the morning.

After she received a text from the 35-year-old man she drove her car to pick him up at about 1.30am and suggested she tie him up and have sex.

The court heard despite the man offering her to come back to his residence she declined and said: “That is boring, this will be fun.”

The 18-year-old started to drive around before she stopped the vehicle and proceeded to strap him up with ratchet straps found in the back seat.

But the court heard while the man originally consented he soon started to try to free himself and asked Dodd to “loosen it, I’m not enjoying it”.

The woman jumped into the drivers seat and started to drive in an “erratic manner”, speeding and swerving from side to side, the court heard.

After he yelled “don’t leave me”, she grabbed a knife and tried to cut him free but fled soon after which left the man to be freed by others.

Dodd pleaded guilty to charges of take and detain with intent to obtain a psychological advantage, drive without being licensed and drive in a manner dangerous.

In Newcastle District Court on Tuesday her solicitor said his client - who had recently given birth - had quite a traumatic history which included substance abuse.

He said she now had the support of her family and had demonstrated her willingness to change now as a mum.

Judge Roy Ellis said the man’s detention was for a relatively short period and despite not condoning it, explained that injury and emotional harm was not substantial.

“He had consented to engage in some type of kinky sexual activity with the offender but at some point he decided he no longer wished to do that and he was detained until she left,” he said.

He cited she had good prospects of rehabilitation and had shown remorse with her depraved upbringing and mental health issues seen to reduce her moral culpability.

Dodd was sentenced to a one year and eight month intensive correction order, disqualified from driving for 12 months and slapped with a $200 fine.

Conditions on the sentence imposed was that she abstain from illicit substances

Mr Ellis said her past had been “difficult and problematic” but urged her to learn from her mistakes and focus on the future.
