In Newcastle Local Court on Wednesday, a charge of sexual intercourse without consent was withdrawn against the former Business Port Stephens board member and hospitality entrepreneur Jonathon Paul Voll.

The Director of Public Prosecutions (DPP) confirmed there will be no further proceedings relating to that charge which court documents said related to an alleged incident against a woman at Nelson Bay on August 4.

Voll entered a plea of not guilty to a charge of sexually touching on the night of July 7, 2022.

The matter will return to Raymond Terrace Local Court in August for a hearing date to be set.

There was a quick mention for a raft of charges that remain relating to the alleged rape of a woman on September 3 last year.

A court previously heard the 43-year-old had been at a work function at one of his Nelson Bay business premises where several people were drinking, when it is alleged he sexually assaulted an intoxicated woman after tackling her to the ground.

A passer-by called triple-0 after it’s alleged she heard a woman screaming, and when police arrived the court heard Voll was allegedly found with her underwear in his pocket.

It is understood CCTV footage will form part of the prosecution case.

Voll is facing 25 serious charges which include sexual intercourse without consent, aggravated sexual assault, take and detain a person with intent to obtain and advantage and common assault.

That has been adjourned until July 30.
