Nelson Bay businessman Jonathon Paul Voll released on NSW Supreme Court bail while facing sex charges

A Port Stephens businessman will need to abide by a booze and pub ban, a curfew and undergo electronic monitoring after being released on bail despite a judge describing the case against him as strong.

Port Stephens businessman Jonathon Paul Voll will need to abide by a booze ban and 10pm curfew, stay away from his former coastal home and undergo electronic monitoring after being released on NSW Supreme Court bail more than nine months after his arrest on sexual assault charges.

Justice Hament Dhanji acknowledged on Tuesday the strength of the prosecution case against Voll but noted the long delay before any trial and the 44-year-old’s lack of a criminal record as factors in his decision.

Justice Dhanji said the electronic monitoring, a $50,000 surety from an acceptable person, an alcohol and drug ban which includes not being allowed in a licensed premises, a nightly curfew and not going within 100km of Nelson Bay could all mitigate concerns about Voll being released on bail.

Voll will also need to give up his passport, not go near an international terminal and report daily to police.

He will live in Sydney and will only be permitted to go within 100km of Nelson Bay for court – where he next faces Newcastle Local Court next week on more than two dozen charges including aggravated sexual intercourse without consent and detaining for advantage.

The surety will need to be deposited and electronic monitoring fitted before he is released from custody for the first time since his arrest in the early hours of September 3 last year.

The former Business Port Stephens board member and hospitality entrepreneur had been at a work function at one of his Nelson Bay business premises where several people were drinking, when it is alleged he raped an intoxicated woman after tackling her to the ground.

A triple-0 call at 12.45am was made by a passer-by who had allegedly heard a woman screaming, and when police arrived the court heard Voll was allegedly found with her underwear in his pocket.

The NSW Supreme Court on Tuesday heard that CCTV footage would form a significant part of the prosecution case against Voll, with prosecutors alleging the assault was captured on security vision.

Voll is also facing a sexual touching allegation from 2022.

Solicitor Elie Rahme, for Voll, said the matters were still in the local court and any trial would not be held in the district court until late 2026 at the earliest, meaning Voll could have been in custody on remand for two years.

Voll also had no criminal history, had family ties and would remain well away from Port Stephens.
