Katie Holmes, 31, sentenced on disqualified driving charge while on parole for killing Anne Bourke at Heddon Greta

A woman who was caught driving while disqualified just months after being released from jail for killing a pedestrian has escaped a jail term. But she remains behind bars after her parole was revoked.

A woman remains behind bars despite being sentenced to a community correction order for disqualified driving just months after being released for running over and killing a pedestrian while speeding with methamphetamine in her system.

Katie Lee Holmes, 31, will have to wait for a fresh hearing next month before learning whether she may be conditionally released after her parole was revoked following her arrest driving in the Hunter Valley in August.

Holmes, who was sentenced to a maximum of three years and three months in jail with a non-parole period of 21 months after killing Anne Bourke at Heddon Greta in 2020, faced Singleton Local Court on Thursday.

She had pleaded guilty to the disqualified driving charge in Scone Local Court the previous day, before magistrate Kevin Hockey sentenced her to the 12-month order.

She was also disqualified from driving for 12 months.

As part of the conditions of the order, Holmes will remain under the supervision of a community corrections officer at Lake Macquarie and must report to the office within seven days of being released from custody.

The exact time of her release is still unclear, with Holmes now awaiting a NSW State Parole Authority review hearing on November 5 after she was sent back into custody on September 22.

Her parole was revoked after she was arrested on the New England Highway at Whittingham on August 31 after being caught driving while disqualified.

She did produce a Queensland driver’s licence despite a NSW District Court judge banning her from driving until October 28, 2027.

Holmes was jailed after a jury found her guilty of dangerous driving occasioning the death of Ms Bourke on February 15, 2020.

Ms Bourke was attempting to cross Main Rd at Heddon Greta about 10.50pm when Holmes’ Mazda struck and killed her.

Experts told her trial that Holmes was estimated to be travelling up to 94km/h in a 60lm/h zone and tests later revealed she had methamphetamine and amphetamine in her system.

She faced a trial and was found guilty in July 2022 before being sentenced to a maximum of three years and three months in jail with a non-parole period of 21 months.

Holmes was released on parole on April 28 before her arrest in August.

She faced Newcastle Bail Court on September 1 on the disqualified driving charge and was granted conditional bail, those conditions including reporting to Scone police station three days a week, not drink or take drugs and not occupy the driver’s seat of any motor vehicle.

Holmes was also required to enter an agreement to forfeit $1000 if she failed to keep her bail conditions, as well as an acceptable person to agree to forfeit $5000.

However, her parole on the dangerous driving occasioning death charge was revoked and she was placed back into custody on September 22.

Her full sentence on the dangerous driving occasioning death charge was due to expire on October 25 next year, although that has now been extended to November 16 next year following the revocation.
