A labourer said he couldn’t remember a random sexual attack on a woman as she tried to leave work, where he shoved her into her car telling her “no one will hear you scream”.

David John Greentree from Windale was enjoying Christmas festivities with colleagues on December 10 last year, jumping from pub to pub before attacking a 23-year-old woman, putting his hand around her throat and sexually assaulting her.

The 48-year-old initially pleaded not guilty with a trial set for August but last week pleaded guilty to a charge of sexual intercourse without consent, while a charge of aggravated sexual assault was dropped.

Police facts said during a night of drinking, Greentree – who had a history of alcoholism – was walking along Maitland Rd at Islington with work mates when he started to act inappropriately, before being told to stop.

While colleagues gained entry into the next pub just after 11pm, Greentree was refused due to his intoxication and ended up walking away after an argument with security.

Police facts revealed Greentree then walked off on his own before the attack on the woman, pushing her into her van and grabbing her neck after she had finished her shift at work.

Court documents stated the victim recalled Greentree’s “eyes were vicious looking” as he struggled with her and pressed the weight of his body against her to bundle her into the vehicle.

“What the f**k, get off me,” the woman yelled according to the police facts.

Despite screaming for help and punching him to the head approximately 15 times, he said to her, “no one is going to hear you scream” before sexually assaulting the woman.

Luckily she caught the attention of a passer-by who intervened and chased Greentree away before triple-0 was called.

After the attack, police facts detailed how Greentree then gained entry to the Kent Hotel at Hamilton and continued drinking before texting and calling his wife to pick him up.

When she finally arrived at around 2am, he was asleep on the grass outside the King St McDonalds.

Following a police investigation and forensic examination of the van and sunglasses which fell off Greentree during the attack, he was arrested at his workplace three days later.

He told police he had no knowledge of what happened.

“I’m not saying I didn’t do it, I’m just saying I don’t have memory of it,” he said according to police facts.

“No way I wouldn’t have done that, I can’t remember, I didn’t do it, I just can’t believe it happened.”

He will be sentenced in March next year.
