Mohsin Naveed convicted in Bankstown Local Court after he choked his wife during an argument

A man has faced court after choking his wife during a fight over suspicions he was having an affair. The woman had to run out to the couple’s balcony to get away from him and call police.

A Pakistani man tried to strangle his wife during a fight which began over her suspicions he was having an affair.

Mohsin Naveed, 30, choked his wife of two years, Rebecca Naveed, on their bed after finding out she had been in contact with one of his friends or family members on Facebook regarding her suspicions.

According to documents submitted to Bankstown Local Court, Naveed and Rebecca got married on July 1, 2017, “as a result of the accused having problems getting an Australian visa”.

Naveed had been in Australia for around five years and is listed in the court documents as being unemployed.

The court heard Rebecca had previously stayed at a women’s shelter for a short period having been emotionally and verbally abused by her husband.

But she had not reported this to police at the time.

Around 1pm on Thursday, February 21, 2019, Rebecca was in the living room of their Reynolds St unit at Bankstown, when she received Facebook messages from a friend or family member of Naveed.

She went to the balcony and used Facebook from her mobile until her phone battery died. She went to the bedroom to charge the mobile phone when Naveed heard the sound of the phone restarting and sat on top of her.

“The accused had both hands on her throat with the thumb heavily on the victim’s oesophagus”, the court documents said.

She began to cough before kicking her legs and scratching around his forearm and shoulder.

The court heard Naveed used his elbows to pin down the victim’s arms and also put his knees around the victim’s legs to stop her from kicking.

“I can’t breathe,” Rebecca cried.

“I don’t care, I hope you die,” Naveed said.

In her panic, she told her husband that she had not responded to the texts she had received and said she would unlock her phone.

He then reached for her phone giving Rebecca the opportunity to wiggle out under him.

Rebecca grabbed his mobile and ran out to the balcony where she called triple-0.

Naveed was taken to the police station and denied allegations of choking his wife, saying she assaulted him.

“However, the accused could not explain how the injuries occurred to her throat,” the documents said.

The police officer said in the documents that he had seen the fresh marks on Rebecca’s neck and also some dried blood near the mark.

Magistrate Glen Walsh convicted Naveed of intentionally choking person without consent and assault occasioning actual bodily harm.

He will hand down his sentence on April 15 at the same court after a sentencing assessment report, with Naveed to report to Burwood Local Court within seven days.
