A young alleged gang member charged with murder after a teen died in a street brawl said to have been provoked by Sydney’s postcode wars is once again pleading for his freedom after he was charged with supplying cannabis gummy bears.

Ibrahima Diallo, 22, was charged with breaching bail, two counts of prohibited drug supply, dealing with crime proceeds and participating in a criminal group after he was arrested at a Bass Hill home on March 27.

Officers attached to Strike Force Delrine allegedly seized cannabis, cannabis oil, THC-infused products including gummy bears, more than $18,000 cash and electronic devices as part of the investigation.

Diallo has now been in custody on remand for four days during a complex bail application on his drug supply charges and a detention application in relation to a previous, unrelated murder charge.

Police will allege the native messaging app on Diallo’s iPhone constitutes an encrypted messaging app – which he was prohibited from using as part of his bail conditions after he was charged with murder

Diallo and several other alleged members of western Sydney gang “Money Over Bitches” or MoB were charged with the murder of a 17-year-old boy during a street brawl in Blacktown in September 2021.

The brawl was alleged to have unfolded against the backdrop of Sydney’s so-called postcode wars – ongoing violence perpetrated by young gang members from competing postcodes.

Diallo intends to fight the murder charge at trial.

At Bankstown Local Court on Friday, barrister AJ Karim told Magistrate Glenn Walsh his client admitted to the technical bail breach, but that it was inadvertent as Diallo was unaware Messages is classified as encrypted.

On the bail application for Diallo’s drug charges, Mr Karim said there was no evidence Diallo was involved in large commercial drug supply, and that texts detected by police only indicate a significantly smaller role.

“I concede, without a doubt, there is at least evidence to the effect that there is some sort of supply occurring and that the applicant is involved,” Mr Karim told the court.

“To assert that he’s involved in the commercial supply or that he’s involved in the proceeds of crime of $19,000 – that just can’t be sustained.”

However, prosecutor Yavin Kumar told the court it would not be satisfied Diallo would not endanger the safety of the community due to allegations about his criminal associations arising from both the drug supply and murder investigations.

“He is a member of a known criminal group, Money Over Bitches, and has come under police notice mainly related to the ongoing postcode wars in greater Sydney,” Mr Kumar said.

“These criminal links between the applicant and his group present a risk of future violence among members of the community – and the dial-a-dealer scheme, that in and of itself highlights an ongoing concern to the community’s safety.”

Mr Walsh adjourned the matter for a fourth day to make a decision and write a judgment in the matter.

He will deliver his bail determination on Tuesday.
