Ibrahima Diallo allegedly breached bail, charged with drug supply, deal with criminal proceeds

A man who allegedly distributed THC-infused lollies as part of a drug supply network – and will soon defend an unrelated murder charge at trial – has made a bid for bail.

A man who allegedly distributed THC-infused lollies as part of a drug supply network, and will soon face trial for an unrelated murder charge, is making a bid for bail.

Ibrahima Diallo was arrested at a Bass Hill home on Monday and taken to Bankstown police station where he was charged with breach of bail, two counts of supplying a prohibited drug including one more than large commercial quantity, participate criminal group – contributing to criminal activity and dealing with property – proceeds of crime.

At Bankstown Local Court on Wednesday, the 22-year-old’s barrister AJ Karim told the court his client was unaware he had allegedly breached his bail conditions.

Mr Karim said “there’s likely to be an agreement” between the defence and prosecution that Diallo had “encrypted devices” on his phone.

As part of his bail conditions in relation to the murder charge, he was “not to have any applications for any encrypted messaging applications on his mobile phone”.

“They (the encrypted applications) were on his phone at the time, [but] there is absolutely no evidence from the crown, police or any other body that they were downloaded subsequent of him being granted bail,” Mr Karim said.

The court heard Diallo was oblivious to the fact the applications, including FaceTime and iMessage, were encrypted.

Magistrate Glenn Walsh said he was “looking forward to the argument” in relation to the encrypted applications and adjourned the matter to Friday.

“I’m older than everyone in the room and [even] I know something about encrypted apps,” he said.

Mr Karim said he didn’t know iMessage was an encrypted app, but was aware that WhatsApp and Wickr were.

In court, Mr Walsh asked “wasn’t Wickr being allegedly used by [Diallo]?”

Mr Karim said there was no evidence that was the case.

As part of the drug supply investigation, officers from Strike Force Delrine allegedly seized cannabis, cannabis oil, tetrahydrocannabinol (THC)-infused products, more than $18,000 in cash, documentation and electronic devices – including laptops and tablets.

Police will allege Diallo had been distributing prohibited THC-infused lollies, before selling the confectionary as prohibited drugs.

Diallo had been on bail for charges relating to the stabbing death of a 17-year-old boy at Bankstown in 2021. He is defending the charge.

Diallo remains remanded in custody. The matter will return to court on Friday.
