A man has avoided conviction after a “disturbed” female neighbour filmed him masturbating pantsless in his front yard while grinning up at her bedroom window.
Thomas Delalis, 26, first caught his neighbour’s attention on August 5 when he walked out of his Menai home with his hand down his pants, rubbing his groin in a “backwards and forwards motion”.
“The accused did this for about three minutes,” agreed police facts stated.
“As he was performing this conduct he was looking in the direction of the victim’s second-storey window, smiling.”
As the victim called her partner, Delalis then emerged from his open garage and walked onto his driveway naked from the waist down.
“He was once again masturbating by using his right hand to manipulate his penis,” agreed police facts stated.
“The accused was seen looking with a smile on his face in the direction of the victim, who was still standing in the window filming the incident.”
Delalis then retreated behind a bush for some time, leaving only his naked lower half visible to the victim.
He pleaded guilty to exposing himself in view of a public place at Sutherland Local Court and Magistrate Michael Connell sentenced him to a two-year conditional release order.
The maximum penalty for wilful exposure is six months’ imprisonment or a $1100 fine.
“It’s obviously concerning behaviour and it’s hard to understand why the offender did what he did,” Mr Connell told the court.
“He has expressed his remorse and apologised for his behaviour.”
The court heard Delalis had attended a counsellor and a program encouraging positive lifestyle choices after the unsettling incident.
He was also forced to live with a relative in Sydney’s west for the victim’s protection until the matter was resolved.
His solicitor told the court Delalis, who is an electrical contractor, was extremely embarrassed about his behaviour.
