A magistrate has slammed a security guard who coaxed a drunk woman into his car after a boozy birthday celebration at a Sydney RSL and ran his hand up her leg until she was so afraid she exited the car while it was still moving.

A court heard Saeed Hakimzadeh, 35, had just finished his shift as a security guard at Cronulla RSL before he bumped into the upset, vulnerable young woman when she was separated from her friends.

When she was too drunk to book an Uber, Hakimzadeh offered her a lift home.

“Due to her high level of intoxication, the victim agreed to the offer of a lift home,” agreed police facts stated.

“The victim stated she was very emotional and talking with the accused when he placed his hand halfway along her right thigh and rubbed it back and forth.”

The frightened woman repeatedly pushed his hand away and frantically texted a friend “this dude’s trying to touch my vagina” before pushing his hand away and escaping the car as Hakimzadeh rolled forward.

Police withdrew one additional charge of sexual touching and Hakimzadeh pleaded guilty to common assault before Magistrate Les Mabbutt at Sutherland Local Court.

He was convicted, sentenced to a two-year community corrections order and fined $1700.

“That young woman put her trust in you, she was in a vulnerable position,” Mr Mabbutt said.

“Some people would say you took advantage of a young woman who was intoxicated.”

The western Sydney man was fined $1700 and ordered to be of good behaviour for two years.

Hakimzadeh’s lawyer Peter Kondich told the court the Northmead man characterised his interaction with the woman as a response to “mixed messages”, but accepted that his actions were wrong.

“It’s in no way how members of the community expect people to behave,” Mr Mabbutt said.

“It occurred when this young woman put her trust in you, and there was no bodily harm on this occasion but the court recognises the harm done to her as a result of your actions.”

Hakimzadeh, who is now married, will be required to be of good behaviour as the sole condition of his court orders.
