A Sydney mum caught drug driving had taken illicit substances three days earlier while celebrating her birthday before she was busted by a random breath test. Less than two weeks later she was charged again – with drink driving.
A Sydney mum caught drug driving had taken illicit substances three days earlier while celebrating her birthday before she was busted by a random breath test.
Rachel Lee Potter, 34, had cannabis and methamphetamine in her system when she was drug tested by police as she drove on the Kingsway in Caringbah on October 6 last year.
Potter pleaded guilty at Sutherland Local Court to driving with an illicit drug in her system and low range drink driving in a separate incident less than two weeks later.
“In relation to the taking of drugs, the accused stated ‘On my birthday, October 3, it was just at my house’,” the agreed police facts stated.
Just 12 days later, Potter was caught out again by police.
“Police were conducting random breath tests on Sturt Rd in Cronulla,” the facts stated.
“The breath test returned a positive result before the accused was placed under arrest and conveyed to Miranda police station for breath analysis.”
Potter returned a low range result of 0.055 and was subsequently charged.
“The accused stated that she had consumed three shots of tequila with her first drink consumed at 6.30pm and the last at 8.10pm,” the facts stated.
“The accused emitted a moderate odour of intoxicating liquor, was periodically emotional and had pale skin and watery, bloodshot eyes.”
Magistrate Michael Connell convicted Potter, fined her $300 and disqualified her from driving for three months.
Potter’s lawyer said the Helensburgh woman was in her pyjamas dashing to the shops around the corner for bread for lunch the following day when she was charged with drink driving.
