A relapsed alcoholic had a full bottle of Southern Comfort worth 18 standard drinks the night before he got in the car with two children and drove erratically up the footpath in front of bemused police officers.

Nicholas Robson, 34, was drink driving at four times the legal limit when his Mitsubishi Outlander mounted the kerb multiple times before he was stopped by off-duty police officers in Sutherland at 9.30am on December 15.

Robson pleaded guilty to high range drink driving after he returned a breath analysis reading of 0.211 at Sutherland police station.

“He was asked about the circumstances of his drinking, where he stated he was an alcoholic currently receiving treatment but he had relapsed a few days prior,” the agreed police facts stated.

“The accused stated he was drinking Southern Comfort bourbon at home in the early hours of the morning – he advised he had drunk a 700ml bottle, approximately 18 standard drinks, mixed with Diet Coke.”

Robson will be sentenced at Sutherland Local Court on March 7.

Police made a report to Family and Community Services when Robson was arrested in relation to the two children travelling with him when he was apprehended.

Neither Robson nor the children in his company were injured in the incident.

“Police observed the accused’s state of dress to be disorderly, with buttons on his shirt undone or fastened in the wrong buttonhole, and with red and black stains on his white shirt,” the agreed police facts stated.

Robson’s licence was already suspended in October 2018 due to demerit point loss, though he told officers he was unaware of that.

The court heard the Grays Point man had one prior low range drink driving offence on his record from 2008.
