A Sydney man accused of assaulting police after an afternoon jetski ride allegedly devolved into a brawl last year has had his bail varied so he can go to the gym and dine out.
Mohammad Bazzi, 20, was on a curfew preventing him from leaving his Chester Hill home after 8pm after he and his friend Mouman Baradaaji, 20, allegedly slapped a man in an unprovoked attack at Lugarno Marina on November 5 last year.
Bazzi and Baradaaji are accused of assaulting the arresting officers from St George police before they were subdued with pepper (OC) spray.
However, Bazzi successfully had his curfew deleted after his solicitor argued his current employment as a plumber combined with the curfew prevented him from “going to the gym or going out for dinner”.
Bazzi will instead be required to report to police seven days a week instead of three in lieu of the previously assigned evening curfew.
The young man is facing charges of common assault, affray, assaulting police, obstructing police and resisting police and is not permitted to enter Lugarno or go jetskiing as part of his bail conditions.
Bazzi’s co-accused Baradaaji has been in prison on remand since the pair were arrested in November.
The 20-year-old Revesby man has pleaded not guilty to four counts of assaulting police, resisting an officer, resisting arrest, assault, affray and intimidation after the Lugarno incident.
Police will allege Baradaaji spat in a police officer’s mouth after he was subdued with OC spray.
He will next face Sutherland Local Court via audiovisual link on February 5.
