Revesby man Mouman Baradaaji, 20, will spend the start of summer behind bars instead of on the water after he was refused bail at Sutherland Court today.
Baradaaji pleaded not guilty to four counts of assaulting police, resisting an officer, resisting arrest, assault, affray and intimidation after a brief conversation boiled over at Lugarno in Sydney’s south.
Five police officers were treated for minor injuries after Baradaaji and his friend Mohammad Bazzi allegedly had a heated exchange with another man at Lugarno Marina on November 5.
Botany Bay Water police arrived at the scene after a confrontation between the pair and another man at a nearby restaurant balcony
The men allegedly became aggressive before arresting officers from St George Police Area command escorted them from the restaurant.
Baradaaji and Bazzi were subdued with OC spray then arrested.
Magistrate Kate Thompson rejected Baradaaji’s solicitor’s submission he needed bail to treat injuries from an earlier incident, including broken ribs and metal plates in his hands, which were exacerbated by Sunday’s arrest.
“(The injury) wasn’t so bad he could not go jetskiing,” Ms Thompson pointed out.
Baradaaji will remain in custody until his next court date via audiovisual link on December 18.
Chester Hill man Bazzi was charged with assault, affray, assaulting police, wilfully obstructing an officer and resisting arrest in relation to the same incident.
Bazzi was granted bail after Ms Thompson said the facts seemed to indicate Baradaaji was allegedly the primary offender in the altercation.
His strict bail conditions include reporting three times a week, a curfew between 8pm and 6am, not to enter Lugarno or go jetskiing, and refrain from contacting Baradaaji.
Ms Thompson acknowledged both men had a history of violent offences and had both spent time in custody in her bail decisions.
Baradaaji works in his brother’s airconditioning business while Bazzi works as an apprentice plumber.
Marine Area Commander Superintendent Mark Hutchings said authorities would not tolerate anti-social behaviour on the water.
“We will be taking a zero tolerance approach toward this type of behaviour and other criminal activity,” Supt Hutchings said.
“The waterways are to be enjoyed by members of the public without the harassment and bullying of some individuals.”
