A public footpath obstruction and water pollution has cost a developer almost $230,000 in fines after a court found they repeatedly breached a southern Sydney council’s development conditions.
SAF Developments had appealed six penalty notices Georges River Council issued due to development consent breaches at a Connells Point site.
The breaches included an obstructed public footpath, water pollution, defective signage, inadequate sediment and erosion controls and tree protection measures.
Magistrate Walsh at Sutherland Local Court found the offences were proven and imposed a penalty of $227,000 in addition to $2500 for the council’s court costs.
Mr Walsh described the developer’s “wanton disregard” to planning laws and the “substantial disruption” it had caused the community.
Georges River Council’s acting general manager Laurie O’Connor said the conviction sent a strong message to developers and builders alike.
“Georges River Council and the courts are committed to enforcing the development control system for the benefit of the local community and environment,” Mr O’Connor said.
