A Sydney father will return home to his family after four months apart after a court dismissed a domestic assault charge against him.
A single charge of common assault against Rockdale man Nathan Gibbons, 26, was withdrawn at Sutherland Local Court today along with an apprehended violence order protecting his young wife.
Gibbons pleaded not guilty to the charge prior to its dismissal today.
Gibbons spent several hours in police custody before he appeared in the dock at Sutherland Local Court on March 8 after police arrested him at his Rockdale home.
The university student and road design trainee was charged after police photographed an “injury which is five inches long and two inches wide, deep purple in colour” on his wife’s arm.
Gibbons was ordered to live with his parents in Northmead after he was granted bail in March but as the charge is withdrawn will now be permitted to return to his home with his wife.
