A Sutherland Shire Council employee convicted of possessing cocaine has offered the same magistrate the same excuse as star musician Shannon Noll - he was mourning the death of his father.
Bexley man Declan O’Mullane appeared before Sutherland Local Court magistrate Glenn Walsh charged with cocaine possession in bizarrely similar circumstances to the beloved Australian singer, who faced Mr Walsh exactly two weeks earlier.
Like Nollsy, O’Mullane pleaded guilty and received a 12-month good behaviour bond with no fine.
O’Mullane’s solicitor said the 25-year-old man was using cocaine as he struggled to cope with the death of his father two weeks prior.
His Uber driver had called an ambulance and police after O’Mullane vomited in his car as they travelled through Beverley Park at 2am on July 21.
Police found O’Mullane “hunching over his legs in a foetal-like position on the road” in Jubilee Ave.
O’Mullane said to police “I’m cold, I’m so cold, search me, just lock me up or drive me home” as they attended the scene.
A subsequent search located 2.75g of cocaine in three clear resealable bags emblazoned with a yellow and black Batman logo.
“Your dad wouldn’t want you to do this, to be dragged over the coals by an old magistrate,” Mr Walsh said to O’Mullane.
“Serve his memory correctly. You’re getting too old for this stuff.”
However, Mr Walsh admonished O’Mullane’s solicitor for his submission that O’Mullane had been “drinking himself silly” and was trying to straighten himself out when he bought the drugs.
“If he is in such poor financial circumstances and has a child, why is he buying cocaine? He’s got no money, but he’s magically finding this guy to buy cocaine from?” Mr Walsh asked.
“People think I’ve walked onto the bench, with no experience, and that I’m an idiot. Make your submissions in accordance with the bench.”
O’Mullane made headlines in 2011 when he was 18 years old and got into a wild brawl with another young man outside Manly Local Court after he pleaded guilty to spitting blood on a 54-year-old female transit officer and damaging her car.
