Stuart Tyler, Timothy Dubois allegedly raped woman at Sutherland Motel

Two men – who worked at Qantas – made bids for bail after they allegedly subjected a woman to a violent and degrading rape inside a south Sydney motel.

Two men have been refused bail after they allegedly subjected a woman to a violent and degrading rape inside a south Sydney motel.

Stuart Kenneth Tyler, 48, and Timothy Richard Dubios, 67, appeared in Sutherland Local Court over allegations they both had sexual intercourse with a woman without her consent.

The court heard both men worked at Qantas, however Dubios left the industry during the pandemic after 47 years with the company and has since been self employed as a limousine driver.

Documents tendered to court said Tyler and a woman allegedly met at Sutherland Motel, where they booked a room in February.

Tyler allegedly requested the woman perform oral sex on him, which she did because Tyler had allegedly previously threatened her when she refused his instructions.

The documents state that Tyler received a message from his friend, Dubois, who said he had arrived before Tyler allegedly told the woman he was there “to f--- you”.

The woman allegedly told Tyler she did not want to have sex with his friend before he replied, “don’t embarrass me, you will obey me, I own you”.

Documents said Dubois allegedly entered the room and spoke to Tyler before he introduced himself to the woman as “Graeme”.

After a few minutes, Tyler allegedly told the woman to “just relax”.

Documents state Dubios allegedly had anal sex with the woman and she pleaded for the assault to stop.

Tyler then allegedly forced the victim to perform oral sex on him.

Dubois allegedly went to the bathroom before the woman resisted Tyler’s alleged request to have oral sex with Dubois.

She told police she did it to avoid being further assaulted, documents said.

Tyler allegedly sexually assaulted the woman again before Dubois allegedly said, “we will do this again” and he left the room.

The woman attended a police station where she detailed the alleged sexual assaults.

Police searched the woman’s car with her permission and located a bag containing white rope, duct tape, a box of condoms, shampoo, unused latex gloves and used gloves containing condoms with bodily fluids.

Tyler was arrested on February 20 and participated in an electronically recorded interview where he allegedly said Dubois was the other man.

Officers also attended the motel where they collected evidence including CCTV, which allegedly shows both men entered the motel.

Dubois, who was arrested on Tuesday, allegedly told police in an interview that his friend, Stuart Tyler, invited him to the hotel where they had consensual sexual intercourse with the woman.

Dubios allegedly told police he did not know her name and that he believed she was a willing participant.

He allegedly also told police he asked Tyler if he needed to bring condoms to which Tyler replied, “it’s OK, she has some”.

Dubois allegedly believed the woman knew he was coming if she brought condoms, adding he also allegedly asked the woman “are you comfortable”, documents said.

The documents said Dubois allegedly did not obtain specific verbal consent to have sex with the woman.

Tyler was charged with five counts of aggravated sexual assault inflicting actual bodily harm, three counts of sexual intercourse without consent, 10 counts of common assault, two counts of intimidation, two counts of armed with intent to commit and indictable offence, three counts of aggravated sexual assault in company, assault causing actual bodily harm.

Dubios was charged with two counts of aggravated sexual assault in the company of another person.

In court on Tuesday, defence lawyer Nicholas Breen said his client had no criminal history, was a married man and had an adult child who lived with him at his Caringbah South home.

Mr Breen submitted Dubios would likely spend years in custody on remand awaiting trial.

He submitted Dubios could abide by a number of bail conditions including a $35,000 surety.

Magistrate Jillian Kiely noted the seriousness of the “violent” allegations adding the woman “actively asked for the activity to stop” but it continued.

She noted if convicted, Dubois would likely be sentenced to full time custody.

Both men will appear in Downing Centre Local Court on April 23.
