A Bondi Beach real estate agent who was allegedly a passenger inside a street racing car moments before brothers were killed has appeared in court for the first time after being charged.

Two boys dead in South Sydney car crash have been identified

A Bondi Beach real estate agent appeared for the first time in court after she was allegedly a passenger in a car that was street racing in the moments before a horror crash which killed two young brothers.

Raquel Marie Borg, 24, from Little Real Estate was charged with concealing a serious indictable offence.

Police allege she witnessed the crash at Monterey, but did not stop or speak to police until she was arrested almost a month later.

Borg was allegedly a passenger in an Audi driven by Adam Yurun, 24, who police say was caught on video street racing a Subaru driven by Jimmy Martin Brito, 33, on August 25.

Just before 10pm, Brito’s Subaru lost control on The Grand Pde and slammed into a pole, killing his nephews Peter Abreu, 9, and Xavier Abreu, 10.

According to a police statement of facts prepared for court in Yurun’s case, the alleged street race began just after 9.30pm when Brito and Yurun met at ‘The Loop’ at La Perouse.

CCTV from various points along the 19km trip to where the crash happened allegedly shows Brito’s Subaru and Yurun’s Audi repeatedly overtaking one another, and at times racing at speeds up to 130km/h in 60km/h zones.

Police allege vision captured on a mobile phone inside the wreckage revealed one of the boys had been taking videos of the alleged street racing and showed the boys directing their uncle which lane to drive in.

As both cars approach The Grand Pde at Brighton-Le-Sands, police allege the racing continued, documents say.

Police allege while Brito tried to negotiate a right-hand bend he mounted the kerb and hit a tree, killing the two boys instantly.

Police further allege the Audi travelling behind didn’t stop. Borg is not accused of causing the accident.

Almost a month after the crash, Yurun was arrested at his parents’ Roselands home on September 21 and charged with charged with two counts of aggravated dangerous driving occasioning death, organise, promote race between vehicles and two counts of fail to stop and render assistance after impact causing death, and remains before the court.

Brito, who was treated in hospital for injuries and was released, was charged with two counts of dangerous driving causing death and one count of causing bodily harm by misconduct, and remains before the courts.

Borg, of Arncliffe, appeared for the first time in Sutherland Local Court on Tuesday after being charged.

The court heard the Director of Public Prosecutions had elected to take carriage of the case, which means the matter will proceed to the district court rather than in local court.

A longer adjournment than usual was sought and granted during the brief mention of the matter.

The case will next be heard on January 11 at Downing Centre Local Court with Borg excused from attending if legally represented.
