An Arncliffe man has claimed a schoolgirl was “crazy” when she confronted him about allegedly filming under her skirt while on the train at Wolli Creek last year.
Peter Peco Stojanovski, 47, appeared in Sutherland Local Court to defend the allegations after he pleaded not guilty to aggravated filming a person‘s private parts without consent, intentionally record intimate image without consent, and attempting to intentionally record intimate image without consent.
Police allege Stojanovski “upskirted” the girl about 3.45pm on September 2 while on the train shortly before arriving at Wolli Creek.
The teen told the court she was with three friends, who were all in their school uniforms, returning home after school.
She said she was standing in front of the downward stairs with her friend in front of her and the other two were near the door.
The teen said Stojanovski was also standing on the downward stairs, below her, when her friend signalled her and said “watch out there may be a guy behind you filming you”.
She said her skirt was about five centimetres above her knees and she turned around to Stojanovski and said “are you filming me, can you please stop”.
The girl said Stojanovski replied, “I am not doing that, are you crazy” before he covered his phone on the top with his hand.
She said she then saw him select about four or five videos and delete them from his camera roll.
The girl then called Triple 0 and gave a description of Stojanovski.
She told the operator the man had used flash, which she told the court she did not see herself but her friend told her had been used.
The girl told the operator she was not injured, nor touched, and there had been no verbal altercation, but one of her friends had taken a photo of the man before he left the carriage at Wolli Creek.
The girl gave a statement to police later that day.
During cross examination, the girl said she did not see the man place a phone under her skirt nor him film anything.
The teenager was asked how she saw the videos being deleted when the phone was covered and facing towards the man to which she replied her view was not completely obstructed and she was looking down above him.
“It is not true to say you saw his phone screen,” the defence lawyer said.
“That is not true,” the girl replied.
The lawyer suggested Stojanovski told the girl he was on Gumtree and he told her to call police, which she did not remember him saying.
The girl denied Stojanovski offered to show her his phone.
The case was adjourned to April 28 for a second day of hearing for the evidence of the girl’s three friends and an adult who was also on the train.
