Nathan Banicevic sentenced for violent attack on ex-partner at North Bexley home

A support worker threatened to “flog” his ex-partner, then arrived at the man’s house 20 minutes later where he attacked and drove his car towards them in an incident of shocking violence.

A support worker threatened to “flog” and “smash” the face of his ex-partner arrived at his house 20 minutes later where he threw pavers at him and drove his car at him, a court has heard.

Nathan Frank Banicevic, 40, was sentenced in Sutherland Local Court to a jail term in the community after a violent domestic violence incident with his former partner last year.

Agreed facts tendered to court saiy the Arncliffe man – who was an Indigenous support worker – and his former partner were in a two-year relationship which ended in 2019 but they were still in contact.

Those facts state Banicevic sent the man abusive Facebook messages and attempted to call him about 7.30pm on December 29.

“I’ll smash ya face in if I see you again you’re dead, you dog,” Banicevic wrote.

“I’m gunna f------ flog you, you worthless piece of shit. Answer your f------ call or I will come around. It will be on.”

Twenty minutes later, Banicevic arrived at the man’s North Bexley home and told him “I’m gonna cave your head in” before he tried to fight him.

The man felt he was going to be assaulted and tried to call police.

Banicevic picked up a paver from the front lawn and attempted to strike the man but it hit his hands as he was trying to defend himself.

Banicevic proceeded to push and snap the man’s bamboo fence before he picked up two pot plants and threw them at the man’s car.

He then got into his own car and accelerated, mounted the grass, crossed the footpath and drove at the man quickly causing him to jump over the fence to avoid being hit, according to the agreed facts.

Banicevic also threw two pavers at the man’s car, causing $4000 in damage due to a smashed back windscreen and tail-light.

He also ran up behind his ex-partner and attempted to hit him before he left.

Police attended a short time later and Banicevic was arrested the next day.

He pleaded guilty to using a carriage service to menace, harass or offend, knowingly driving a menacing manner, two counts of common assault, intimidation and three counts of damaging property.

In court, Magistrate Jillian Kiely noted Banicevic threatened violence then acted upon it causing thousands of dollars in damage.

She took into account Banicevic suffered from depression and anxiety at the time and his mental health had deteriorated due to issues with his employment and animosity towards his ex-partner.

The court heard Banicevic was now in new relationship, medicated and had a new employment. He was sentenced to a 15-month intensive correction order and disqualified from driving for 12 months.
