An elderly Sydney man accused of sexually assaulting a disabled teenage boy inside a train station toilet has made a surprising move at his latest court appearance.

An elderly man accused of detaining and sexually assaulting a teenage boy with an intellectual disability inside a Sydney train station toilet has abandoned his bid for bail in court.

Mortdale man Bryce Grainger first appeared before Sutherland Local Court on Monday charged with aggravated sexual intercourse with a child aged between 14 and 16, and intentionally sexually touching a child aged between 10 and 16 years.

About 3pm on Saturday, police allege a 15-year-old boy was detained and sexually assaulted by a man they believe to be Grainger.

The incident was reported by the alleged victim to his mother, who subsequently contacted police.

The 75-year-old man was arrested at a Mortdale unit where clothing and electronic devices were seized.

The court granted a 24-hour adjournment to prepare a bail application for Tuesday, before a Legal Aid solicitor advised the court Grainger had decided not to proceed with the application.

Magistrate Phillip Stewart instead adjourned Grainger’s matters, which include an apprehended violence order for the boy’s protection, to Central Local Court on May 31.

Grainger will now be subject to the early applicable guilty plea process, which allows defendants accused of serious crimes more time to decide their response to the case against them without losing their eligibility for a discount on sentence if they plead guilty early.

Court documents reveal the 15-year-old complainant in the matter has a cognitive impairment.

Grainger will remain in custody on remand until his next court appearance, and appeared calm and relaxed when he appeared in court via the audiovisual link.
