Former Sutherland Shire real estate agent refutes child sex allegations

A man who accuses a former Sydney real estate agent of sexually abusing him as a child has vehemently shot down suggestions he was the sexual aggressor in an alleged incident when he was 17.

A man has denied initiating and then forcefully continuing a sexual encounter with a former Sydney real estate agent who he accuses of sexually abusing him when he was a child.

The former Sutherland Shire realtor – who cannot be named – is defending nine charges at a Sydney District Court trial in relation to sexual abuse allegations made by a man who was then 12, 13 and 17.

The court has heard the nine charges relate to three separate alleged incidents in 2004, 2005 and 2010.

The Crown case is that the former realtor exposed himself to the boy and forced the boy to masturbate him in the back of a car in Cronulla in 2004, when the boy was 12.

The Crown further alleges the former realtor performed oral sex on the boy; forced the boy to give him oral sex; convinced the boy to try and anally penetrate him; and then penetrated the boy in 2005 when the boy was 13.

The former realtor denies either of these incidents occurred at all.

In the third incident, the Crown case is that the former realtor entered the boy’s bedroom at his parents’ home, touched his penis under his blankets while he was half asleep, and then performed oral sex on the boy without his consent.

The pair then had intercourse, for which the former realtor has not been charged.

During cross-examination, the complainant repeatedly became too emotional and overwhelmed to continue, asking for breaks until he was able to compose himself.

The man could be seen breathing heavily and shaking as he repeatedly recounted details from the alleged incidents.

On Monday, the former realtor's barrister Mr Stewart advanced a different version of events to the complainant during cross-examination.

Mr Stewart suggested the former realtor and boy had discussed sexual matters, and the former realtor’s sexual encounters with men, earlier on the night of the third alleged incident.

“No, did not happen,” the complainant responded.

“It was you that suggested he could come and sleep in your room,” Mr Stewart said.

“No,” the complainant responded.

“When you got to your room, you started to masturbate in front of (the realtor),” Mr Stewart said.

“No, that did not happen,” the complainant responded.

“You told him you had been wanking over him in the last couple of days,” Mr Stewart pressed.

“That definitely did not happen,” the complainant said.

Mr Stewart then suggested the complainant and the realtor had kissed, he had stroked the realtor’s genitalia and performed oral sex on him, and – despite the realtor’s protests – rolled him over, held him down and had anal sex with him, causing him to bleed.

“No, did not happen,” the complainant said repeatedly.

The defence barrister had also suggested photos of the complainant and the former realtor together at a music festival indicated they had an “affectionate” relationship and the complainant was comfortable around him.

“No, never,” the complainant responded, before asking for a break.

The trial continues on Tuesday.
