A man on the child protection register allegedly told police he “slipped up” when he recorded a man in a toilet cubicle inside Westfield Miranda, a court has heard.

Daniel Michael Taylor, 35, was charged with observing a person in a private act without consent and applied for bail in Sutherland Local Court on Tuesday.

The court heard Taylor, who lives in Miranda, went into a public bathroom of the large shopping centre during the afternoon of April 28.

Police allege Taylor went into a toilet cubicle and held his phone over the top of the stall wall where he recorded an adult man inside before he removed his phone.

Police allege CCTV showed Taylor entering and exiting the bathroom before they were able to track him going into a games store where he used his name and provided his mobile phone.

Officers claim a tattoo on his arm also matched the footage.

Police allege Taylor went into more toilets that day, and were able to track him going into bathrooms on multiple other days in April, the court heard.

Police further allege Taylor had apps Twitter, OnlyFans, Instagram and Riot Mobile on his phone which he is prohibited from accessing.

The court heard Taylor allegedly told police during an interview, “I slipped up” and said he went into the bathroom for “voyeurism”.

The court heard Taylor’s criminal history dates back to 2013 and he has previous convictions for filming a person without consent and possessing child abuse material.

A police prosecutor opposed Taylor’s release noting the risk of him committing other sexual offences in public was high given his criminal record.

Taylor’s lawyer said his client had been working full time as a qualified butcher and had a friend in court who could support him but noted his parents lived in Queensland.

The lawyer said bail conditions including reporting to police daily, abiding by a curfew, a restriction not to enter Westfield Miranda and a surety could mitigate the risks.

However Magistrate Philip Stewart said the prosecution case against Taylor was “overwhelmingly strong”.

He said Taylor had made admissions to police, and CCTV footage “showed a pattern of conduct”, adding a sentence of full time custody was likely.

Taylor wept throughout the bail application and when he was refused release, with the case adjourned to May 15.
