A repeat domestic violence offender has narrowly avoided jail after he threatened to “choke out” a woman while he was holding a cord.

Aidan Grant Nunan, 30, of Wollongong was sentenced in Sutherland Local Court on Wednesday after he pleaded guilty to damaging property, intimidation and common assault.

Agreed facts tendered to court said Nunan was at a woman’s Sutherland house in October when he became aggressive and made the woman scared before she asked him to leave.

Nunan then threatened the woman and said, “I am going to hurt you” and “I and going to kill youse all”.

He held a cord in both hands and as he walked towards the woman he said, “I am going to choke you out”.

A short time later Nunan threw a glass object close to the woman and it hit the wall, leaving a small hole, about 30cm away from where she was standing, documents state.

The woman told police she was scared throughout the incident and feared she would be harmed.

Police arrested Nunan at Woolloomooloo on November 4 in relation to the incident.

Magistrate Philip Stewart said Nunan had an “appalling record” for previous domestic violence offences where he had received terms of imprisonment for intimidation, assault and contravening apprehended domestic violence orders.

He said the offence was more serious because it was committed in the woman’s home and he used a cord and glass to threaten her.

Mr Stewart said Nunan had made progress towards rehabilitation and completed domestic violence and addiction programs, adding he had not reoffended since the incident.

He said there was still a risk Nunan could reoffend but allowed him to serve a jail sentence in the community.

“You must stop, hopefully today it will stop,” Mr Stewart told Nunan.

Nunan was sentenced to a 15-month intensive correction order where he must be monitored electronically and abstain from drugs, do drug rehabilitation, and attend domestic violence prevention and cultural awareness courses.
