A drunk driver has learned his punishment for driving three times over the alcohol limit and vomiting out the window of his car in Mascot in full view of a police officer.

Thanh Nguyen, 27, who hails from Victoria but lives in Botany, appeared in Waverley Local Court on Wednesday and pleaded guilty to high-range drink driving.

The court heard the lift technician was driving along Wentworth Ave in Mascot about 5am on Saturday, August 29, when an off-duty officer witnessed his shocking behaviour behind the wheel.

“He stopped in the middle of both (westbound) lanes and began to vomit out the driver’s side window,” the agreed facts stated.

Police stopped him in his Toyota Camry and he failed a roadside breath test.

He was taken to Mascot Police Station and returned a breath analysis of 0.156 – three times the alcohol limit for a driver on a full licence.

In court on Wednesday, Nguyen said he was remorseful for his behaviour that day for getting behind the wheel while intoxicated.

“At the time of the incident I did not think of the repercussions in my life.”

Magistrate Michael Antrum warned him he would be facing a possible jail sentence if he were to be charged again with drink driving.

He was sentenced at Waverley Local Court.

“If you get another high-range the prospects of you going to prison are greatly increased.”

Magistrate Antrum convicted him, fined him $1500, and sentenced him to a community corrections order for eight months.

He also disqualified him from driving for eight months to be followed by an interlock licence for 24 months.

While it was Nguyen’s first high-range offence, the court heard he had a special-range drink driving offence on his record from when he was a P-plater in Victoria.
