A man who planted what a magistrate said appeared to be a “fake Molotov cocktail” on a Palestine supporter’s car may be facing further charges after the matter was referred to the Commonwealth Director of Public Prosecutions.
David Maurice Wise, 43, was charged with leaving or sending a substance or article to create false danger, two counts of intimidation, using a carriage service to menace or harass and entering inclosed lands without lawful excuse in relation to an incident in Botany.
Police were called to Daphne St, Botany on January 5 after a resident found a suspicious item on his car with a note reading “ENOUGH! TAKE DOWN FLAG! ONE CHANCE!!!!”
The resident whose car it was had a Palestine flag outside his home at the time.
It was further alleged the same resident allegedly received a threatening phone call on February 16, prompting the man to again alert police.
The eastern suburbs pool builder has now pleaded guilty to all five charges, with consent for the Commonwealth carriage service charge to proceed in the local court.
But Wise – who is behind bars on remand after his bail was refused – could be facing further charges, the court has heard.
A police prosecutor told Magistrate Susan McIntyre at Downing Centre Local Court that Wise’s matter has now been referred to the Commonwealth Director of Public Prosecutions.
The court heard this referral was not intended so current charges would proceed on indictment in the District Court, but so additional charges could be contemplated due to the nature of the offending.
Wise’s barrister consented to the adjournment for the referral to the Commonwealth DPP, asking Ms McIntyre to set the next date for a possible bail application, Mental Health Act application or sentence.
The matter was adjourned to April 23.
