The man was re-sentenced at Blacktown Local Court on March 13 after an order to reopen the case was made by the Chief Magistrate because the Blacktown Advocate identified an error in his original sentence.

The child abuse material possession charge is classified as a prescribed sexual offence and a jail sentence to be served in the community as an intensive corrections order was not available to the court.

The man was re-sentenced to a 12-month jail term - but with a non-parole period of just four days.

He was released to parole on March 16.

MAN MISSES COURT AFTER SENTENCE ERROR IDENTIFIED - FEBRUARY 21

The 50-year-old man, of Seven Hills, was sentenced to a jail term in the community after he published TikTok videos where he brandished guns, threatened to bash his ex and kill his son which ultimately led police to his sickening trove of child abuse material.

The man was to be re-sentenced at Blacktown Local Court on Monday after an order by the Chief Magistrate after the Blacktown Advocate identified an error in his original sentence.

Due to the nature of the crime, a jail sentence to be served in the community was not available to the court.

In Blacktown Local Court on Monday, the Seven Hills man was given a two week reprieve after Magistrate Brian van Zuylen adjourned the matter until March 14 and noted the man didn’t have a history of failing to appear at court.

“I imposed a prison sentence of 12 months to serve as an intensive corrections order on February 10. It has been brought to my attention that I am not able to make an intensive corrections order for this charge,” said Magistrate van Zuylen

“It was relisted today for sentence correction. He has not attended court.

“In the court’s view because he attended on three prior occasions, the court considered a warrant for his arrest but I am going to adjourn it until Monday March 14, 2022 for sentence,” he said.

If the 50-year old man fails to appear on that date, a warrant will be issued for his arrest.

Tik Tok threats unwittingly uncover deeper child crimes – February 14, 2022

A western Sydney man’s terrifying TikTok antics in which he brandished guns and threatened to bash his ex and kill his son led police to a sickening trove of child abuse material at his home.

The 50-year-old Seven Hills man – who cannot be identified – kicked off a campaign of abuse with a distasteful TikTok video he posted about his ex-partner on March 6 last year.

Despite several months of violent threats and his foul stash of child abuse material – followed by an extraordinary address in a Sydney court in which he said he came from a family of killers – the man was not going to spend any time behind bars for his vile behaviour.

But after the Blacktown Advocate alerted the court to an error in the man’s sentence, the Chief Magistrate has ordered the proceedings to be reopened so the mistake can be corrected.

Magistrate Brian van Zuylen had sentenced the man to an intensive corrections order for possessing child abuse material – which is unavailable as a sentence for prescribed sexual offences such as child abuse material possession.

If the court determines that a prescribed sexual offence is sufficiently serious to warrant a term of imprisonment, it can only be served as full-time jail and not in the community as an intensive corrections order.

“The court has recognised that a sentencing error has occurred and therefore on its own motion, pursuant to s43 of the Crimes (Sentencing Procedure) Act 1999, reopened the proceedings to correct the sentencing error,” a spokeswoman for the Chief Magistrate’s Office said.

“Accordingly, the matter has been relisted for this purpose on February 21 2022.”

At the man’s initial sentence date, the court heard grave details of his campaign of abuse against his son and his ex-partner.

“Hey my beautiful boy, mate this two faced b**** has destroyed us in every way she can,” the father said in his first video on March 6.

“I’m at the point where I’m going to send someone around and break her legs and you’re going to hate me, and I can’t do that, so I have to step back now.”

What followed was a slew of revolting abuse on a range of social platforms.

On May 27, the man posted a TikTok holding what appeared to be a black pump action shotgun with the song Monster, about a deteriorating state of mental health,overlaid.

Months later on September 21, the man texted his 12-year-old son saying “u (sic) bring those two into my life again I’ll shoot them both dead take care”.

The man’s behaviour devolved even further by September 28, where a happy birthday text to his son cratered into more foul-mouthed abuse.

“I simply got used up and spat out by U ungrateful f**** and UR mother run like the coward she is answering for nothing like she always has, I’d mind your manners c*** U think ur out of my reach I can have someone on ur doorstep in 20 minutes you prick remember it,” the man wrote.

“Sooner or later I’ll run into the three of you U won’t walk away d**khead, when I grab U by the throat and start hit UR face don’t call me dad c***.”

The man finished his foul rant with a final warning, saying “Tell ur mates the same u f****** prick”.

The man then turned his attention to his ex-partner, messaging her on Facebook to say “don’t ever cross my path as u will be lucky to survive.”

He then reached out to the woman’s sister, saying, “I’m going to burn ur sister to the f****** ground u get involved I will take you too.”

“I’m going to send the worst f****** dogs I can find the lowest f**** on earth.”

“I have never been so angry in my life and I’m going to f*** this c*** like u have never seen.”

The police finally became involved when the man’s terrified son provided a statement saying he believed he had seen a shotgun at his father’s home, along with a duffel bag which he believed could contain a gun.

On September 29, police raided the man’s home at Station Rd in Seven Hills where they ultimately found no weapons – but instead an array of child abuse material during their probe of the man’s social media messages.

A full search warrant at his property on September 30 uncovered four child abuse images, depicting pre-pubescent females aged approximately six to 10 year old with a highly sexualised focus.

Agreed facts tendered to Blacktown Local Court state police also found 72 Google search phrases including “free very young girls forbidden porn,” “pre-teen porn galleries” and “darkweb pre-teen porn galleries”.

The man’s iPhone was also found to have 208 child abuse images on it following a police search.

At Blacktown Local Court on Thursday, the man said the word “kill” was natural to him as he came from a family of war veterans – but swore he had never laid a finger on his children.

“I came from a family of killers and the word kill is second nature to me,” he said.

“I also promise you I have never put even a finger on my children.”

As for the images on his phone the 50-year old stated, “all I am saying is they were on my phone, but that’s not saying I looked at them though.”

Magistrate Brian van Zuylen said the offending was “incredibly serious” and described the social media messages as “utterly appalling.”

“I take into account that your father was a Vietnam veteran and you have been around children and never harmed them in any way,” Mr van Zuylen said.

“But with that being said possession of child abuse material is incredibly serious.”

The 50-year old pleaded guilty to using a carriage service to threaten to kill, using a carriage service to menace, using a carriage service to threaten serious harm and two counts of possessing child abuse material.

For the threats, Mr van Zuylen convicted and sentenced him to a 12-month Commonwealth recognisance order to be of good behaviour and submit to supervision by Community Corrections, with a $1000 security to be paid only if the man breaches the bond.

For the child abuse material possession, the man was initially sentenced to a 12-month intensive corrections order and fined $1000 for each offence – but this sentence will be corrected at Blacktown Local Court on February 21.

“I am of the view that there is no other option than full time imprisonment but it will be served in the community by way of an intensive corrections order,” Mr van Zuylen concluded at the time.

The day started with a text to his son wishing him a happy birthday to which his son replied “OK, you have a good day.”

What followed was a slew of abuse from the 50-year old

At this point his 12-year old son went to police where he provided a statement. He told police he believed he had seen a shotgun at his dad’s residence as well as a black coloured duffel bag on top of a cabinet which he believed may have contained a gun.

September 29, 2021

Police subsequently searched his property on Station Road, Seven Hills, where they did not find any guns but upon searching for the social media messages uncovered child abuse material.

He was then taken to Riverstone Police Station where he refused to be interviewed.

September 30, 2021

A search warrant was executed at his property, where police uncovered four images that were classified as child abuse on a MacBook Air, depicting pre-pubescent females approximately 6 to 10 with the image focusing on the anal or genital region.

The Police Fact Sheet states they also found 72 google searches phrases that contained but weren’t limited to “free very young girls forbidden porn,” “pre-teen porn galleries” and “darkweb pre-teen porn galleries”

A review of his black iPhone also uncovered 208 images classified as ‘child abuse’.
