A man who police allege told a woman they would “die together” before he allegedly deliberately crashed his car into a telephone pole will be released from custody.

Toni Sese, 48, of St Marys, was granted strict conditional bail in Penrith Local Court on Friday on charges of attempted murder and cause grievous bodily harm to a person with content.

The court heard Sese was driving north on Mamre Rd, St Marys, with a 23-year-old woman known to him in the passenger seat in January.

Police allege Sese deliberately steered the car into a power pole near the corner of Mamre Rd and John St, St Marys, and will allege he also undid both his and the woman’s seatbelts before the crash.

She suffered serious arm injuries in the crash.

The prosecution opposed bail, saying there was a high risk of Sese not appearing at future court appearances due to the seriousness of his charges.

They also said there was a high risk of danger to both the community and his alleged victim.

However, his defence team said he was willing to surrender his passport and not go within one kilometre of any international point of departure as part of proposed bail conditions.

Magistrate Vivien Swain granted bail, saying there were conditions that could ameliorate any concerns the prosecution had.

She said it was “difficult to assess the strength of the prosecution’s case” as it relied “entirely on evidence from the complainant”.

The woman told police the man had told her they’d “die together” before the crash, but Sese maintains he lost control of the vehicle.

Sese’s bail contains 14 strict conditions.

He must live at an address in North St Marys and not leave it unless going to work, a planned medical appointment, or to see his lawyers. He must present at the front door of his house or his workplace if requested by police.

He must surrender his passport before leaving custody, and must not go within one kilometre of any international point of departure.

He must not contact his daughter or any witnesses of the crash, and must not drink or take any drugs unless prescribed by a doctor.

He is also banned from driving or sitting in the driver’s seat of any vehicle.
