A young man who spat on a security guard at Penrith Panthers after being asked to undergo an alcohol assessment has pleaded guilty to a charge of affray.
Dylan Brown, 24, of Hassall Grove, faced Magistrate Geoffrey Hiatt at Penrith Local Court almost a year to the day after the early-morning incident.
He faces charges of affray, common assault, and excluded person failing to leave premises. Two other charges were withdrawn prior to today.
According to police facts, Brown was in the gaming area of the leagues club at about 2.50am on September 22 when he was approached by security guard Ali Scheiwani and asked to undertake an alcohol assessment.
Brown became defensive, and pushed Mr Scheiwani with his right hand before adopting a fighting stance, according to court documents.
He later attempted to offer Mr Scheiwani his hand for a handshake, but spat on his chest when the offer was refused.
Brown then walked towards another man, Mostafa Mohebibi, and adopted the same fighting stance before he was escorted towards the main foyer.
He refused to leave, and started swinging his arms at Mr Mohebibi, Smiljan Nikic, and Tony Ristovski, but didn’t make any contact.
The four men were forced to take Brown to the ground to get him under control.
According to the facts, Brown broke free from the men’s grasp, and he was once again tackled to the ground, causing a cut to the inside of his right cheek.
Police attended just after 3am and took him into another room away from the public. They reported that he was compliant after police took over.
He was later taken to hospital for treatment to his cheek.
In court, Magistrate Hiatt ordered a sentencing assessment report to help determine Brown’s punishment.
He adjourned the matter to October 29 for sentence.
