Oxley Park: Emily Jane Smith faces court over alleged stabbing

A young mum accused of stabbing a man in a western Sydney unit leaving him in an induced coma has faced court.

A young mum who allegedly stabbed a man during a violent incident at an Oxley Park unit last night has been remanded in custody.

Police allege Emily Jane Smith, 26, of Oxley Park, and another person stabbed a 28-year-old man in the abdomen at a Braddon St unit at about 9.15pm on Wednesday night.

A court heard the man was in an induced coma at Westmead Hospital on Thursday morning.

Police will allege Smith and another person approached the front door holding knives prior to the stabbing.

She appeared before Magistrate Jennifer Atkinson at Penrith Local Court this morning on charges of wounding with intent to cause grievous bodily harm, reckless wounding company, and armed with intent to commit an indictable offence.

She did not enter a plea.

Smith’s lawyer argued in court the victim had no way of knowing she had been involved as his back was turned when he was stabbed.

“The victim was allegedly stabbed while he was walking away, so how could he see it was the accused that stabbed him?,” he said.

He also said the victim had arrived at the address with a baseball bat, opening an element of self defence in the case.

“There isn’t anything on her record which suggests a serious or significant history of violence,” he said.

“There’s no history of offending while on bail, and no history of failing to appear.

“Bail could be granted in this case, as there are no risks that couldn’t be dealt with with specific conditions.”

The prosecution opposed bail, saying there was a risk of witness and evidence tampering.

“The co-offender is outstanding, and we’re worried about collusion,” he said.

“The facts are very serious in nature as are the offences, and it’s safe to say it’s a strong prosecution case.

“Whether it’s the accused or co-accused who stabbed the victim, there’s regard for joint criminal enterprise.

“We concede the victim had a baseball bat, but we suggest the persons inside the residence could have locked the door and called police.

“There are no bail conditions that could be approved that would ameliorate the risk.

Magistrate Atkinson refused bail, saying the defence hadn’t offered sufficient reason.

Smith will next appear in court in May 7 via audiovisual link.
