A man accused of attempting to grope a paramedic while she was assisting him will remain in police custody.
Garang Aguern, 45, of Mt Druitt, appeared before Magistrate Janine Lacy via audiovisual link in Penrith Local Court on January 22 and pleaded not guilty to charges of sexually touching without consent, offensive behaviour in a public place, and common assault.
Magistrate Lacy said the alleged victim and another paramedic responded to reports Aguern was lying in the gutter at about 4.20pm on January 21.
She said Aguern allegedly first told paramedics to “f*** off” before allegedly spreading his legs and touching his genitalia.
He then allegedly started to raise his fingers towards the woman’s vagina while implying that he would pay her for sexual acts, the court heard.
Magistrate Lacy said while the alleged victim was attempting to get Aguern into the ambulance, he then allegedly reached for her vagina before running his hand up the inside of the victim’s left thigh.
Aguern’s defence lawyer argued he wasn’t a potential flight risk while applying for bail.
He said Aguern would agree to live at an address in Mt Druitt and abstain from all alcohol.
However the prosecutor opposed bail, saying Aguern presented an “unacceptable risk” to the community.
She argued Aguern wouldn’t hold to proposed bail conditions as he had a pattern of breaching bonds that included abstinence.
Magistrate Lacy acknowledged that Aguern had no history of sexual crimes, but said she had little confidence of his compliance with court orders.
She refused bail, saying the alleged offence was of “great concern to the court and the community”, and that “paramedics should not be placed into situations such as this”.
Aguern will next appear before court on February 26.
