Mikkel Isaac makes bail to be with family, attend wife Dayna Isaac’s funeral

The husband of allegedly murdered mum Dayna Isaac has made a bid for bail to attend her funeral in the same court fronted by the man charged with her murder just two days earlier.

The husband of allegedly murdered mum Dayna Isaac has made a bid for bail to attend her funeral in the same court fronted by the man charged with her murder just two days earlier.

Mikkel Isaac, 30, of Bathurst, was expressionless as he appeared to Penrith Local Court via video link, after previously pleading guilty to supplying large commercial quantity of cocaine, supplying commercial quantity of cannabis, participating in group criminal enterprise and supplying a prohibited revolver.

His late wife, Dayna Isaac, 28, was left bloodied and suffering a serious head injury on the floor of her Penrith home after allegedly being murdered by her drunk boyfriend Paul Jason Sultana, 32, on Monday afternoon.

The court heard Mikkel and Dayna Issac had separated but spoke on the night before her alleged murder where there was some discussion about reconciling their relationship and moving forward as a family.

Isaac has been in custody since his arrest in May of 2021, with police alleging he is a principal person of interest in a large scale cocaine syndicate operating throughout Bathurst and western Sydney.

On Friday, Mikkel Isaac’s lawyer told the court the bail release application was based on “exceptional circumstances” stemming from Dayna Isaac’s recent death with Isaac seeking to be with his family, receive grief counselling and to attend her funeral.

The court heard Isaac’s grandmother was willing to put up $500,000 in surety for her grandson’s release.

The police prosecutor addressed a tense courtroom when she argued the alleged circumstances of Dayna Isaac’s death were not exceptional reasons for her husband to be bailed.

“The sad circumstances of today are not contested, her death was tragic and catastrophic for her family,” the prosecutor said.

“The difficulty is these circumstances are not unique, in this jurisdiction it is not uncommon for people to lose family members while in custody.

“The circumstances of her death are exceptional, but his wishes to be at liberty are not.”

Isaac’s lawyer disagreed, asking the court to “consider the case on its own facts”.

“Losing a loved one in custody because they might be ill or from some sort of misadventure is very different to finding out your wife has been murdered, leaving your two young children without a parent,” he said.

“My client is distraught, devastated and inconsolable, how could someone go through the grieving process in that setting?”

Magistrate Stephen Corry considered all submissions made to the court before refusing bail, ruling he was not satisfied the “high bar for special or exceptional circumstances” had been met.

“Given that people in otherwise unexceptional circumstances do die when their loved ones are in custody, the matters that flow as a consequence from an accused person being in custody need to be separated from the death itself,” Mr Corry said.

“It’s important not to lose sight of the serious set of charges the accused is in custody for.”

Mikkel Isaac will remain on remand before he is committed to sentence, expected to take place towards the middle of the year.
