Mikkel Isaac: Husband of Dayna Issac in new Supreme Court bail bid to attend late wife’s funeral

The husband of allegedly murdered mum Dayna Isaac has made a new bail bid to be with his family and attend his late wife’s funeral with a court hearing he was ‘distraught and inconsolable’.

The husband of allegedly murdered mum Dayna Isaac has been granted bail to attend his late wife’s funeral - just three days after an earlier application for bail was refused in a Sydney court.

Mikkel Isaac, 30, formerly of Bathurst, has spent 22 months in remand after previously pleading guilty to supplying large commercial quantity of cocaine, supplying commercial quantity of cannabis, participating in group criminal enterprise and supplying a prohibited revolver.

He will be committed to sentence towards the middle of the year.

On Monday, the NSW Supreme Court approved an urgent release application lodged by Isaac after a previous bail application was refused in Penrith Local Court on Friday.

On Friday, Local Court Magistrate Stephen Corry ruled the application did not meet the bar for special or exceptional circumstances.

Mikkel Issac’s late wife, Dayna Isaac, 28, was left bloodied and suffering a serious head injury on the floor of her Penrith home after allegedly being murdered by her drunk boyfriend Paul Jason Sultana, 32, last Monday.

Mikkel Isaac’s solicitor Osman Samin told the Supreme Court hearing that Isaac was “distraught and inconsolable”.

“He’s locked in his cell for days on end and to regurgitate these thoughts would be mind numbing,” Mr Samin said.

The court heard the couple had been temporarily separated but were looking at reconciling their relationship, and the evening prior to her alleged murder, husband and wife had spoken about their future together,

“The deceased had formed some sort of realisation that she no longer wanted to be with that person, and instead wanted to be with Mikkel,” Mr Samin said.

Supreme Court justice Dina Yehia granted Isaac bail, saying she was confident the 30-year-old did not pose a flight risk.

“This is a man who understands he is going to be serving a considerable amount of time for firearm and commercial drug supply related offences,” she said.

“It is a situation comparable to the example of a natural disaster because his wife and the mother of his chilfen is alleged to have been brutally murdered.”

Justice Yehia then addressed Isaac directly when handing down her decision:

“Mr Isaac I am granting you bail today on account of the following, you’ve pleaded guilty, you’ve taken responsibility, you haven’t made a previous bail application and you understand you have to return to court to complete your sentence,” she said.

“I am more confident you are not going to flee the jurisdiction or abandon your children.”

Isaac’s release comes with a lengthy set of conditions prohibiting him from entering a licensed premise, using encrypted messenger apps, or leaving the house aside from attending his late wife’s funeral or attending daily to the police station.

In addition, $500,000 in surety by way of mortgage has been offered up which will be forfeited if Isaac is found to have breached his conditions.

Mikkel Isaac will remain on bail before he is committed to sentence.
