A teenager who police allege broke into a woman’s home, assaulted her, and stole a Fetch TV Box has flagged her intentions to apply for the charges to be dismissed under the Mental Health Act.
Madalyn Selwood, 19, of Werrington County, appeared in Penrith Local Court on Friday before Magistrate Brian van Zuylen.
She is charged with assault occasioning actual bodily harm, possessing a prohibited drug, intentionally or recklessly damage property, larceny, and aggravated break-and-enter over the alleged incident in Cambridge Park on December 10 last year.
According to court documents, police will allege Ms Selwood broke into a house on Barker St, Cambridge Park, sometime between 1.20pm and 2pm.
Police allege she assaulted a young woman inside the home, before stealing a Fetch TV Box worth $450.
She also allegedly damaged the door frame of the front door, and was allegedly in possession of Xanax tablets at the time.
Ms Selwood was granted bail shortly after the alleged offending, and her lawyer announced an intention to have the charges dismissed with a Section 32 application under the Mental Health Act.
Section 32 states a Magistrate may dismiss charges against a defendant if they find them to be cognitively impaired, suffering from a mental illness, or suffering from a mental condition for which treatment is available in a mental-health facility.
If successful, a Section 32 application generally ends with the defendant being released into the care of a responsible person or into a mental health facility.
Ms Selwood’s matter was adjourned to April 9 at Penrith Local Court.
