A western Sydney man is facing a potential trial in the District Court after he was charged with a serious break-and-enter offence.

Luke Spencer, 28, of St Marys, faced Magistrate Geoffrey Hiatt on charges of aggravated break and enter with intent to commit a serious indictable offence and intentionally or recklessly destroy/damage property over an alleged incident in Colyton on August 31.

According to court documents, police will allege Spencer and three co-accused broke into the home of Teleaha Bower just after 3pm with the intent to intimidate her.

Police will also allege Spencer damaged several external windows of the home.

One of Spencer’s co-accused, Shannon Brooks, faced Penrith Local Court earlier this month and was refused bail for his alleged involvement in the incident.

He is charged with aggravated break and enter and driving while suspended.

Another co-accused, Kimberley Downes, will face court next week on charges of stalk/intimidate with intent to cause fear, aggravated break and enter, and destroy or damage property.

Spencer was not represented by a lawyer during a brief mention of his matter in Penrith Local Court on Monday.

Magistrate Hiatt explained that his matter was an EAGP (early appropriate guilty pleas) matter and would be before the courts until at least next year.

“This is a strictly indictable offence,” Magistrate Hiatt said.

Luke Spencer will next appear before Penrith Local Court on November 20.

“I make brief service orders by November 20, and the matters will be adjourned to that date.

“After brief service, the matter will then be adjourned for six weeks for a charge certification, then after that, and subject to pleas, you’ll be committed to the District Court for trial or sentence.

“If you’re going to see a solicitor about your matter, you need to do it quickly.”

Spencer also asked Magistrate Hiatt about changing the curfew hours on his bail agreement but was told he would need to lodge an official application to vary his bail through the court registry.

He will next appear at Penrith Local Court on November 20.
