Two young men who “ran through” another man’s home in Bligh Park after a run-in at the pub have been jailed, but must wait to find out how they’ll serve their sentences.
Jesse Souter, 21, of South Windsor, and Oliver Galea, 22, of South Windsor, were sentenced by Judge Siobhan Herbert in Penrith District Court on Thursday.
The pair pleaded guilty to aggravated break and enter in the Local Court last year, while Galea also pleaded guilty to intentionally/recklessly destroy property and resisting police.
Galea appeared in person, while Souter appeared via audiovisual-link as he was negatively impacted by the flooding in the Hawkesbury.
According to police facts, the victim, was previously friends with Galea, but had a falling out sometime before the incident on March 4 last year.
The two saw each other at a pub about three weeks before the break-in, at which time Galea told the victim he was going to do a “run through” of his house.
According to court documents, Souter and Galea broke into the victim’s home in Bligh Park just before 10.30pm on March 4 in the company of one other person.
When the two entered the home, Souter used a baseball bat to hit a dog fence separating the kitchen from the living room.
Galea also attempted to swing his fist at the victim, but didn’t make contact.
They then left the kitchen to search the home, before Galea returned with a metal sword that belonged to the victim. He then left again and was seen on CCTV putting some of the victim’s belongings in his pockets.
The victim eventually jumped out of his laundry window and over a neighbour’s fence, causing Galea and Souter to flee his home.
When he returned home, he found medication, nine pairs of Nike TN sport shoes and three Mark Echo branded watches had been stolen.
He sent Galea and Souter a message on social media saying “I have youse on camera and I want my stuff back”.
In court, Judge Herbert said she acknowledged the two men had made great progress in rehabilitating drug addictions they had at the time of the offending.
She said the offending was “below the mid-range of seriousness”, and accepted both men had shown genuine remorse for the offending.
However, she also said imprisonment was the only reasonable sentence for the offending.
Both men were convicted and sentenced to two years in jail, and Judge Herbert ordered a sentencing assessment report for both men to gauge their suitability for home detention.
They will return to court on May 6 to learn their final sentences.
