Guy Jacob Boyd, 28, of South Penrith, appeared before Penrith local court on Tuesday and was found guilty of stalk/intimidate intend fear of physical harm, destroy or damage property, possess prohibited drug and custody of a knife in a public place.

The court heard it was 10:50pm on February 3 last year when Boyd saw the victim driving a silver Mazda out from a Kingswood street and onto Jamison Rd, Werrington and began following him in his black Holden ute as he continued onto the Northern Rd, Penrith.

He then began to accelerate towards the victim’s car while swerving on the road behind him before speeding past the victim.

The victim was travelling in the right-hand lane on the Northern Rd when Boyd pulled up alongside him and wound down his window, producing a foldable knife which he waved at the victim.

Boyd said “F*** you, you’re a f***ing dog” before driving closer to the victim’s car and swinging the knife at the vehicle. The car left damage on the passenger’s side door.

Magistrate Fiona Toose was particularly taken aback by the behaviour.

“You chose to plunge a knife into the vehicle and that would have terrified the person which it did because they called the police,” the magistrate said.

After stabbing the car, Boyd turned off the Northern Rd and the victim called police who told him to go back to his Kingswood home.

As he started driving back from Penrith, Boyd pulled out from a side street in front of him before taking a hard left onto Jamison Rd and driving away.

When Boyd pulled into his Cambridge Park driveway, police had arrived and told him not to move.

Police searched Boyd due to reports of him having a machete.

Police asked Boyd what happened and he said: “I got into a bit of a road rage with someone and I showed them a bit of a thing”

Boyd told police: “I have a small knife in the car”.

Police asked if the thing he was referring to was a knife and he said “yeah”.

While searching Boyd, police also found 4.36g of cocaine in a zip lock bag in the pocket of his shorts.

Boyd was taken to Penrith Police Station.

While still on scene, police searched Boyd’s car and found a baseball bat between the door and driver’s seat and a flick knife on the front driver’s seat.

Speaking with the victim in Kingswood, police heard he was fearful of Boyd throughout the incident and applied for an apprehended violence order.

Despite his record, Magistrate Toose encouraged Boyd to stay on the straight and narrow, delivering some sober life advice.

“You’ve got a good job and you need to focus on the best version of yourself. You and drugs need to part ways,” she said.

“If someone wants to part ways, they can and the same goes for you. You should not get involved with their new partner.”

Boyd’s lawyer agreed that her client’s behaviour with his ex-partners new beau was inappropriate but argued that his other crimes were less severe.

“It is conceded that the intimidation matters are serious but the possession falls to the lower end of objective seriousness,” she said.

Boyd was found guilty of all offences and was handed a 12 month intensive corrections order for the stalk/intimidate and destroy or damage property charged. He was fined $1000 for possess prohibited drug and $1000 for custody of a knife in a public place.

Boyd has lodged a sentence appeal and will reappear in court in early May.
