Emily Smith, Ricky Oxley of Oxley Park sentenced over grievous bodily harm

A brotherly bust-up which resulted in a missing tooth led to a wild episode of knife violence in Sydney’s west. The two parents responsible for the brutal stabbing have been jailed.

Two parents who violently stabbed a family member following an argument have been jailed.

Emily Smith, 29 and Ricky Oxley, 26, who have been in an on-and-off relationship for nine years, were sentenced in Penrith District Court on Wednesday after a jury found them guilty of grievous bodily harm.

The court heard on March 11, 2020, Oxley, was released from Blacktown Hospitals' mental health unit and dropped by his older brother Kyle’s unit block to collect some belongings, when an argument erupted leading to the older Oxley losing a tooth.

Following the bust-up Kyle Oxley decided to pay his younger sibling a visit where he was staying at Smith’s unit, arming himself with a baseball bat and enlisting two friends to join him.

After being warned “a very angry” Kyle was on the warpath, Oxley and Smith picked up their respective weapons, a dagger and a kitchen knife, as they awaited his visit.

At 10pm, Kyle Oxley and his two henchmen arrived at Smith’s Oxley Park apartment and smashed a car in the driveway with the bat before taking a swing at his younger brother.

After a brief scuffle Ricky Oxley stabbed his brother in the stomach, later described by Kyle as “feeling like a Mack track had hit him”.

Despite having just taken a knife to his stomach Kyle Oxley continued attempting to punch his brother.

At the same moment Kyle knocked his brother out with a punch he was stabbed a second time by Smith, who plunged a knife into the right side of his body.

Kyle then yelled at Smith: “Get it [the knife] out”

Smith yanked the knife out, and in doing widened the gash to his right armpit while yelling:

“die you dog”.

Following the attack Kyle Oxley was taken to hospital with life-threatening injuries, including internal bleeding and a 30cm laceration exposing his chest cavity.

Smith and Ricky Oxley fled the scene before being arrested a short time later.

Both pleaded not guilty to grievous bodily harm to which a jury found them guilty.

The court heard the pair got together as teenagers and hoped to reconcile their relationship in the future.

In character references tendered to the court, Smith was described as a “reliable” and “an extraordinary mother” committed to her children and her offending was a “shock” to those who knew her.

The court heard Smith was worried about how her children would adjust without her.

Judge Karen Robinson took this into account and gave her a discount on her non parole period.

The court heard Oxley had shown “genuine remorse” over the incident and had accepted responsibility for the harmful impact on his family.

Emily Smith, was convicted and sentenced to four years and six months jail, with a non-parole period of two years and three months

Ricky Oxley was convicted and sentenced to five years, and 10 months jail with a non-parole period of three years and six months.
